Investing in real estate remains a popular strategy in France. However, tax rules have changed, old schemes have disappeared, and new ones have emerged. Investing in real estate in 2026 requires understanding these developments before signing anything.

Reintegration of LMNP Depreciation: The Tax Trap at Resale

Are you considering non-professional furnished rental for its tax advantages? The mechanism has been profoundly modified. Since February 15, 2025, the depreciations deducted under the real regime are reintegrated into the calculation of the capital gain upon the sale of the property (Article 84 of the Finance Law for 2025).

Specifically, an investor who has deducted several years of depreciation will see their taxable capital gain increase by that amount at the time of resale. This rule also applies to depreciations prior to this date, according to a ministerial response published in March 2026.

Why is this change so important? Because it significantly reduces the overall advantage of LMNP for those planning to resell after a few years. Short-term ownership of furnished properties is becoming less tax-efficient than before. For investors aiming for the long term and holding onto their property, the impact is less significant, as the allowance for the duration of ownership eventually compensates for part of the burden.

Before choosing between unfurnished and furnished rental, it is now useful to explore the offers on Lc Immo to compare net returns based on the chosen strategy.

Private Landlord Status: The New Real Estate Tax Scheme of 2026

With the end of the Pinel scheme on January 1, 2025, there was a gap for investors seeking an incentivizing tax framework. The Finance Law for 2026 created a new regime applicable to acquisitions made from February 21, 2026, to December 31, 2028.

This scheme imposes specific conditions:

  • Commit to renting the property for a minimum of nine years, which excludes quick resale strategies.
  • Charge a rent lower than the local market price, which mechanically limits the gross yield.
  • The housing must meet energy performance criteria, in line with tightening DPE obligations.

This scheme aims at building wealth, not maximizing yield. The tax advantage is deferred and conditional. It targets a patient investor profile, willing to accept a moderate rent in exchange for a tax reduction spread over time.

DPE and Thermal Sieves: An Often-Underestimated Yield Factor

The energy performance diagnosis is no longer just an administrative document. It now determines whether a property can be rented out. Properties classified as G have already been banned from rental since 2025. Those classified as F will follow.

A poorly rated property in terms of DPE loses both its rental value and its resale value. Conversely, an energetically renovated property can justify a higher rent and attract more stable tenants.

For an investor, this means that the budget for energy renovation work must be included from the outset in the profitability calculation. Buying a cheap but energy-intensive property may seem attractive. In reality, the cost of bringing it up to standard and the loss of rent during the work eat into the margin.

Calculating the Real Yield After Renovation

The gross rental yield is no longer sufficient as an indicator. You must subtract the condominium fees, property tax, insurance, renovation costs, and now the tax impact at resale.

  • The net yield after taxes takes into account the actual taxation based on the chosen regime (micro-property, real, LMNP).
  • The cost of energy renovation must be amortized over the planned holding period.
  • Even short vacancies reduce the real yield by several tenths of a point.
  • Management fees, if you delegate, generally represent a percentage of the rent received.

Real Estate Investment Trusts and Real Estate Crowdfunding: Diversifying Without Buying a Property

Not all investors have the capacity or desire to manage a property directly. SCPI (real estate investment companies) allow access to the real estate market with more modest amounts, without the burden of property management.

SCPI pools the risk across several dozen properties, often spread across different cities or European countries. The yield depends on the quality of the real estate portfolio and the management of the company, but liquidity remains limited compared to a traditional financial investment.

Real estate crowdfunding works differently. It involves lending money to a developer to finance a specific project, with an announced yield and a fixed duration. The main risk is the developer’s default or project delays. The capital is not guaranteed, and the investment is illiquid for the entire duration of the operation.

Choosing Between Direct Management and Delegated Investment

Direct management of a property offers total control over tenant selection, renovations, and resale strategy. It requires time, legal skills, and tolerance for unforeseen events (damage, unpaid rent, vacancy).

Real estate investment trusts eliminate these constraints but also remove the leverage of traditional bank credit, which remains one of the main drivers of profitability in real estate. Leverage allows investing an amount greater than one’s available savings, which amplifies the return on equity when the borrowing rate remains lower than the rental yield.

The choice depends on your personal situation: available time, appetite for management, investment horizon, and risk tolerance. A well-calibrated real estate investment takes all these parameters into account even before looking for a property or financial product.
